DATA PROTECTION STATEMENT.
This page provides information about the methods used to process the personal data of users (the “User” or the “Data Subject”) using the contact form which is available online at the address www.slowear.com (the “Site”) to communicate with Slowear S.p.A. or DIANA E-COMMERCE CORPORATION SRL, an independent data controllers, depending on the subject of the User’s request. This information is provided in accordance with Article 13 of Regulation (EU) 2016/679 (the “Regulation”).
Data controller
DIANA E-COMMERCE CORPORATION SRL, headquartered in Torreglia (PD) Via San Daniele no. 137/139, 35038, VAT no. 05097740285, e-mail privacy@dianacorp.com (“Diana”), is the data controller for personal data pertaining to all requests relating to the sale of products offered on the Site (the “Products”), such as the terms of sale, exercise of the right of cancellation and aftersales services.
Slowear S.p.A. headquartered at Via Fornace 15/17, Mira (VE), VAT number 04246660288, e-mail privacy@slowear.com is the data controller for the personal data for all other requests sent on the contact form, such as a request for information about new collections etc.
Data protection officer (DPO)
Diana has appointed a data protection officer (DPO), who the data subject may contact at: privacy@dianacorp.com.
Legal basis and purpose of the data processing
Slowear and Diana, as independent data controllers, will process your personal data depending on the User’s request, without your express consent, for the following purposes:
A. A. to fulfil your request for information. If necessary, your data may also be used to fulfil any related legal obligations pertaining to statutory or fiscal matters or to enforce or defend a right and/or to prevent or investigate any fraud, or other crimes or offences.
The legal foundation for this type of processing is based on the fulfilment of the contract to which you are party, or pre-contractual measures, legal obligations and legitimate interests of Slowear S.p.A. and Diana in defending or enforcing a right and/or to prevent or investigate any fraud or other criminal offence or crime and therefore such processing by Diana does not require your express consent.
Slowear will only process your personal data with your specific, separate consent, for the following additional purposes:
B. B. with your express consent, for the carrying out of direct marketing, such as the sending, by email, text or video message, of advertising materials and communications with an informative and/or promotional content relating to products or services supplied or promoted by the data controller, including gifts and free samples.
Data conservation period
With specific regard to the purposes described in paragraph A), your personal data will be processed for a period of 3 months from receipt of your request. In the presence of legal obligations your data may be kept for a period of up to 10 years.
With specific regard to the purposes described in paragraph B), your personal data will be processed for 24 months with reference to Marketing, unless your consent is revoked earlier in respect of all, some or one of such purposes.
In any case the data collected on this Site may be kept by Slowear and Diana for longer periods than those indicated above, in order to defend or enforce their rights and/or to prevent or verify any fraud or other offence or crime, within the terms permitted by the applicable laws.
Nature of provision of data and consequences of refusal to provide data
For the purposes indicated in paragraph a) above, the provision of data is not obligatory but it is necessary in order to fulfil your request for information.
For the purposes indicated in paragraph B) the provision of data is optional. Any refusal to provide such data or to provide related consent will make it impossible for Slowear to carry out the direct marketing activities referred to in that paragraph but it will not affect the possibility for the requester to receive the information they require.
Scope of communication of the data; categories of recipient
Only for the purposes indicated above, all the data collected and processed may be disclosed by Slowear and Diana to persons within their organisation who are authorised to process the data in connection with their work. It may also be disclosed to the following categories of external persons in the capacity of independent data controller or external data processor:
- providers of IT services such as direct marketing, Internet services and cloud computing;
- parties responsible for logistics, warehousing, promotion, supply, sale and delivery of the products and services of Slowear and Diana;
- parties providing customer assistance services;
- professional firms and other consultants providing assistance, advice and services such as legal, fiscal, accounting -related, economic/financial, technical/organisational, data-processing or communications -related;
- persons providing banking, financial, insurance and debt recovery services;
- subsidiaries, parent companies, affiliated and connected enterprises;
- public, regulatory or supervisory authorities;
- third-party companies in connection with mergers, acquisitions or disposals of a company or a business unit.
An up-to-date list of the data processors is available on request from Diana and Slowear via the procedures indicated in the “Rights of the data subject” paragraph, below.
No data collected on the Site will be circulated.
Transfer of data to a third country and/or to an international organisation
Your personal data may be transferred, for the purposes for which it was collected, to the United States of America (USA) which is not a European Union country. The transfer of personal data to persons located in the USA will only take place on the basis of standard contractual clauses, signed by Diana and/or Slowear and the non-EU recipient of the data, of the type adopted or approved by the European Commission (Article 46 para. IIc) and d) of the Regulation) or with parties listed on the Privacy Shield list, which is a self-certification scheme for companies based in the USA who intend to receive personal data from the EU in accordance with the implementing decision (EU) 2016/1250 adopted by the European Commission on 12 July 2016. To obtain a copy of that data you may contact Slowear as indicated in the paragraph “Rights of the data subject” below.
Minors
The Site and the related services are not intended for minors and therefore Slowear and Diana will not knowingly collect any online personal data from anyone under the age of 18.
Rights of the data subjects
The data subject may ask Diana and Slowear to have access their personal data and to rectify this data if it is inaccurate, or to erase the data or limit its processing if the conditions are met, or to object to the data processing for the legitimate interests pursued by Diana and Slowear, and to obtain the portability of data provided in person, but only if it relates to automated processing based on consent or on a contract. The data subject may also revoke the consent already given for processing operations that require consent, without affecting the legality of any data processing carried out until the time of revocation.
