This page contains details about the method used to process the personal data of Users registering on this website www.slowear.com (the “Site”) by Slowear S.p.A. and DIANA E-COMMERCE CORPORATION SRL, as independent data controllers.
Slowear S.p.A. headquartered at Via Fornace 15/17, Mira (VE), VAT number 04246660288 e-mail email@example.com (hereinafter “Slowear”) is the data controller of all personal data regarding your registration on this Site, and for marketing and profiling purposes.
DIANA E-COMMERCE CORPORATION SRL, headquartered in Torreglia (PD) Via San Daniele no. 137/139, 35038, VAT no. 05097740285, e-mail firstname.lastname@example.org (hereinafter “Diana”), is the data controller for all activities relating to the sale of products retailed on this Site (the “Products”) including order fulfilment, antifraud checks, accounting and fiscal obligations, product deliveries and the management of payments, returned products, and after sales services.

Diana has appointed a data protection officer (DPO), who the data subject may contact at: email@example.com.
Purpose and legal basis for the data processing
Your personal data will be processed by Slowear for the following purposes:
A. without express consent, to enable your registration on the Site and access to the related services; in relation to these purposes, your consent is not required but the processing of your data is necessary in order for the requested Services to be provided,or in order to fulfil a legal obligation;
B. only with specific, separate consent, for the provision to the Customer, in the form of periodic emails containing advertising and informative material about Slowear products and services as well as any other commercial or non-commercial campaigns (“Marketing”);
C. only with your consent, for individual or aggregated profiling activities and market research which may be aimed at analysing consumer choices and habits, elaborating the related statistics, or evaluating the level of customer satisfaction with the products and services offered (hereinafter “Profiling”).
Your personal data will be processed by Diana for the following purposes:
D. without express consent, for the formation and fulfilment of the contract for the sale of products retailed on the Site, including management and fulfilment of the order, communication of information about the order, antifraud checks for payments, product deliveries, the management of payments and any returned products as well as aftersales assistance, and in order to fulfil legal obligations in accordance with statutory, fiscal and accounting regulations.
The legal basis for the data processing is based on the fulfilment of the contract of sale to which you are a party, the fulfilment of legal obligations (statutory, fiscal and accounting) and Diana’s legitimate interest in verifying the security and absence of fraud in relation to payment transactions. Therefore, the processing of the data by Diana does not require your express consent.
Slowear and Diana may also process your personal data in order to defend or enforce their rights and/or to prevent or investigate any fraud or other crime or offence.
Data conservation period
Your personal data will be processed for the time strictly necessary to pursue the above purposes after which time it will be deleted or anonymized, in particular:
- for the purposes of Site registration referred to in paragraph A), Slowear will automatically erase the data if you do not make an online purchase of Products during 24 months after the date of the last purchase;
- for the profiling and marketing purposes indicated in paragraphs C and B, your personal data will be processed by Slowear for 12 months and 24 months respectively, provided that you do not revoke consent to the data processing before then;
- for the sale of products on the Site referred to in paragraph D), Diana will process your personal data throughout the term of the contract and for no longer than 10 years after termination of the contract, in accordance with its legal statutory, fiscal and accounting obligations.
In any case the data collected on this Site may be kept by Slowear and Diana for longer periods than those indicated above, in order to defend or enforce their rights and/or to prevent or verify any fraud or other offence or crime, within the terms permitted by the applicable laws.
Nature of provision of data and consequences of refusal to provide data
Provision of the personal data indicated in the fields marked with an asterisk (*) for the purposes indicated in paragraphs A) and D) is not obligatory, but it is necessary in order to place orders for the purchase of the Products. If the requested data is not provided, registration on the Site, and the formation and fulfilment of the sale contract, will be impossible. The provision of data in fields not marked with an asterisk, while being useful in facilitating relations with Diana and Slowear, is optional. If this data is not provided, your registration on the Site and the fulfilment of any purchase orders, will not be affected.
Provision of the data for the purposes indicated in points B) and C) is optional. You may decide not to provide any data or to revoke consent for the processing of data already provided: in such a case you will not receive any advertising or informative material, information about Slowear products and services nor about any other commercial or non-commercial campaigns, but you may still register on the Site and place orders for the Products referred to in paragraphs A) and D).
Scope of communication of the data; categories of recipient
Only for the purposes indicated above, all the data collected and processed may be disclosed by Slowear and Diana to persons within their organisation who are authorised to process the data in connection with their work. It may also be disclosed to the following categories of external persons in the capacity of independent data controller or external data processor:
- providers of IT services such as direct marketing, Internet services and cloud computing;
- parties responsible for logistics, warehousing, promotion, supply, sale and delivery of Slowear and Diana products and services;
- parties providing customer assistance services;
- professional firms and other consultants providing assistance, advice and services such as legal, fiscal, accounting -related, economic/financial, technical/organisational, data-processing or communications -related;
- persons providing banking, financial, insurance and debt recovery services;
- persons carrying out security checks and antifraud checks on payments made through the Site;
- subsidiaries, parent companies, affiliated and connected enterprises;
- public, regulatory or supervisory authorities;
- third-party companies in connection with mergers, acquisitions or disposals of a company or a business unit.

No data collected on the Site will be circulated.
Transfer of data to a third country and/or to an international organisation
Your personal data may be transferred, for the purposes for which it was collected, to the United States of America (USA) which is not a European Union country.
The transfer of personal data to persons located in the USA will only take place on the basis of standard contractual clauses, signed by Diana and/or Slowear and the non-EU recipient of the data, of the type adopted or approved by the European Commission (Article 46 para. IIc) and d) of the Regulation) or with parties listed on the Privacy Shield list, which is a self-certification scheme for companies based in the USA who intend to receive personal data from the EU in accordance with the implementing decision (EU) 2016/1250 adopted by the European Commission on 12 July 2016. To obtain a copy of that data you may contact Diana or Slowear as indicated in the paragraph “Rights of the data subject” below.
The Site and the related services are not intended for minors and therefore Slowear and Diana will not knowingly collect any online personal data from anyone under the age of 18.
Rights of the data subjects
The data subject may ask Diana and Slowear to have access their personal data and to rectify this data if it is inaccurate, or to erase the data or limit its processing if the conditions are met, or to object to the data processing for the legitimate interests pursued by Diana and Slowear, and to obtain the portability of data provided in person, but only if it relates to automated processing based on consent or on a contract. The data subject may also revoke the consent already given for processing operations that require consent, without affecting the legality of any data processing carried out until the time of revocation.
